“Adarsh published his first book – Patent Law: Cases and materials- A synthesis for India – in 2020. This book was very well received by the practitioners of patent law in India. He has now followed it with an even more important work – Ramanujan’s Patent Law. Over the last 20 years the Indian patent law has evolved significantly with lot of cases on several aspects of patent law. This book exhaustively deals with Indian patent law under 21 Chapters. I read with interest Chapter 9 – Person Skilled in the Art [PSITA] and expert evidence. He succinctly develops the concept with underpinnings from different jurisdictions. It is one of the most difficult concepts in patent law, especially when determining obviousness and most patent cases involve counter claim of invalidity and obviousness is the most invoked ground for invalidity. Similarly, Chapter 14 on Non-patentable subject matter – New forms etc. also makes very interesting reading. Section 3(d) was criticized as being violative of TRIPS. However, there was no challenge to that section in WTO. Here, Adarsh brings out very lucidly the doctrine of constructive ambiguity in international agreements to show that there was sufficient elbow room for India to have such a section. Overall, the book is very exhaustive and provides full insight into the legislative history, the context, analogous position in EU and USA, the development of cases and the Author’s own insight on all aspects of patent law from filing and prosecution to compulsory license. I congratulate Adarsh for coming out with his second book, that too at a very young age. I have no doubt that the book will be a grand success.”
